Introduction:
Rose Bay Travel Pty Ltd ACN: 003 094 791 is a privately owned registered Company trading as a retail Travel Agency. We provide advice with a high standard of service. We work with travel suppliers with similar standards and ethics. We arrange travel service and sell a Travel Product on behalf of Third Party Travel Providers including airlines, tour and cruise operators, car hirers and accommodation providers. We charge a service fee for providing this service.
Agency:
We provide you with Booking and Advisory Services that allow you to acquire Travel Products from a Provider. We act as agent for the Provider. By acquiring Booking & Advisory Services from us, you agree that you have read and understood our terms and conditions and the terms and conditions of the Providers.
Accreditations & Memberships:
- International Air Transport Association (IATA) allows us to issue tickets for airline members.
- Australian Federation of Travel Agents (AFTA/ATAS)
- Helloworld – a travel buying group
- Virtuoso Travel network – a US based Travel Company connecting Agencies to suppliers in the luxury market.
- Preferred status with leading airlines & Hotel groups including Qantas, Singapore Airlines, Cathay Pacific, Emirates, and Etihad, Mandaring Oriental, Peninsula Hotels, Four Seasons Hotels, The Belmond Group, Intercontinental & Marriott.
Fees:
We charge a fee for providing the Booking & Advisory Services to you. The fee is non- refundable. All fees are outlined in the Schedule of Professional Service Fees.
Booking Terms & Payments:
The Travel Products offered are subject to availability and can be withdrawn without notice by the Provider. Travel Products may also change at any time in accordance with the Provider’s terms and conditions. When making a booking, you must provide details of each traveller correctly. We have no responsibility for any loss or damage arising from the incorrect entry of a traveller’s details.
Prices:
Prices are quoted in Australian dollars or the trading currency of a supplier. When we quote in another currency we advise our clients. We convert to Australian dollars at the best buying rate we can obtain on the day we pay the supplier. Prices are subject to change at the discretion of the supplier and this is out of our control. A price is only guaranteed once paid in full but always at the discretion of the supplier. Prices may include applicable taxes and are often subjected to changes in the value of our Australian dollar.
Refunds & Cancellation Fees:
If you cancel your Travel Product, your right to a refund or credit is subject to the terms and conditions of the Provider. If the Provider is required to provide you with a refund or credit for the Travel Product, we will liaise with the Provider to arrange that refund. Where you are entitled to a refund, we are unable to provide you with this refund until we receive it from the Provider. Please note that most Providers take 60 – 90 days to process any refund. Changes or cancellations to a booking may incur a fee from the supplier and will be advised to you. Rose Bay Travel has a separate cancellation and change fee which will be advised to prior to commitment. Cancellations and amendments for online low cost carrier bookings only: If you flight booking is with a Low Cost carrier, you can only cancel or change your booking by contacting the Provider directly.
Force Majeure:
We will not be liable for any failure or delay in performing our obligations in booking the Travel Product that is due to events beyond our control. If a Force Majeure event occurs that affects your booking, your entitlement to a refund, a credit or re-scheduled travel booking will depend on the Provider’s terms and conditions. If your booking is impacted by a force majeure event and you are entitled to a refund or credit from the Provider, we will facilitate this refund or credit. The Booking and Service Advisory fee, credit card fees or any commissions received are non- refundable in the circumstance that a force majeure event occurs.
Changes in Price and Itineraries:
If a Provider changes any part of your booking for reasons beyond its control, we will use our reasonable endeavours to notify you. If any such changes result in your Travel Product costing more or otherwise being materially different, then you may cancel the Travel Product. Any refund would be subject to the Travel Provider terms and conditions.
Your Obligations and Warranties:
You warrant to us that:
- You are at least 18 years old and have the power, capacity and authority to enter into a binding contract with us and with the Providers of the Travel Products that you acquire.
- You have read and understood these terms and conditions and if booking on behalf of third parties, you have conveyed these terms and conditions to them;
- The information you provide us about yourself is true, accurate, current and complete (apart from any optional items) as required by any registration process;
- You have considered acquiring comprehensive travel insurance and we are not responsible for any failure by you to acquire adequate insurance cover; and
- You warrant and acknowledge that you have accessed the Smartraveller website for any specific enquiries in relation to your intended destination.
- Passport/visa and other required identification documents are your responsibility.
- It is the client’s responsibility to ensure they have correct documents, visas and health requirements for travelling and that your passport is current and for most countries has 6 months’ validity; however Rose Bay Travel will give you assistance. You will not be permitted to board an aircraft if your passport, visa or health documentation are not in order. This includes having six moths’ validity on your passport if required by the country.
- If you travel on a NON Australian passport, even if you a resident of Australia, you require a RE-ENTRY VISA for Australia. This is the responsibility of the client.
- Rose Bay Travel requires your passport to make airline bookings. The booking name must match your passport name. Your date of birth, expiry date of your passport plus you postal code are required by the airline. The airline will not permit you to travel if your booking name does not match your passport or travel identity for travel at check- in.
Schedule of Professional Service Fees:
Service fees: $55.00 Domestic travel
From $250.00 for international economy class airfare per person
From $550.00 for international business class airfare per person

Amendment fees: Changes to Domestic/Trans -Tasman bookings will incur a fee of $44.00 per passenger per booking in addition to Provider and credit card fees.
Cancellation Fees: Cancellations to International bookings will incur a fee of 10% per booking in addition to Provider and credit card fees.
Credit Card Fees: Visa – an additional 1.7% applies Mastercard – an additional 1.7% applies American Express – an additional 1.7% applies
Responsibility:
Rose Bay Travel acts only as agents for the overseas operation or companies providing the tours, transport, accommodation and all other services. All possible care has been taken to ensure that the overseas operators maintain a high standard. However, as do not control any of the service providers, we cannot be responsible for problems arising from your booking unless it is a direct result of negligence on our part or on the part of our employees. In particular, we accept no responsibility or liability for matters outside our control including injury, damage or loss arising from accidents, delays or irregularities, wars, riots, civil strife, terrorist activity, natural disasters, weather conditions, industrial disputes, Government actions etc.
Company Liability:
We do not accept any liability of whatever nature in connection with your travel arrangements which may result in death, personal injury, sickness, accident, loss or any misadventure, however caused. Nor do we accept any liability for any act, omission, or default of any hotelier, carrier or other person or agent employed by them who may be engaged in the provision of accommodation, refreshment, carriage facility or services however caused.
